Terms and sale conditions of MASTER TOILES Company
These terms of sale are concluded between
one hand, MASTER TOILES Company, with a share capital of 38092 €, whose head office is located in Barbezieux, (16300 – France) registered in Register of Commerce and Companies of Angoulême under number 351312970, hereinafter referred to as “MASTER TOILES”, manager of website https://www.mastertoiles.com
and,
on other hand, any natural or legal person wishing to make a purchase via MASTER TOILES website, https://www.mastertoiles.com, hereinafter referred to as “Buyer”.
Article 1: object
Present sale conditions aim at defining contractual relations between MASTER TOILES and Buyer and conditions applicable to any purchase made through MASTER TOILES website, https://www.mastertoiles.com .
Acquisition of a product through this site implies acceptance without reservation by Buyer of these sale conditions, which buyer acknowledges having read prior to his order. Before any transaction, buyer declares to have full legal capacity, allowing him to engage under these terms and sale conditions.
MASTER TOILES Company keeps possibility of modifying, at any time, these sale conditions, in order to respect any new regulation or in order to improve use of its site. Therefore, conditions applicable will be those in effect at Buyer order date.
Article 2. Products
Products offered are those listed on MASTER TOILES company website www.mastertoiles.com, within limits of available stocks. MASTER TOILES reserves right to modify product assortment at any time. Each product is presented on website as a description of its main technical characteristics (capacity, use, composition …). Photographs are as faithful as possible but don’t engage MASTER TOILES in anything. The sale of products presented on website https://www.mastertoiles.com is intended for all buyers resident in countries that fully authorize entry into their territory of these products.
Article 3. Prices listed
Prices listed on product sheets of the internet catalog are prices in Euros (€). MASTER TOILES company reserves right to modify its prices at any time, understood however that price appearing in catalog, day of order, will be the only one applicable to purchaser. Prices quoted don’t include delivery costs, invoiced in addition to the price of products bought, according to total weight of order.
Article 4. Order and payment methods
Before any order, buyer must create an account on https://www.mastertoiles.com. Account creation section is accessible directly from sidebar. At each visit, buyer, if he wishes to order or consult his account (order status, profile …), must identify himself using this information. MASTER TOILES company offers buyer to order and pay for its products in several stages, with 2 payment options to choose from:
– Payment by bank transfer: Buyer selects products he wants to order in the “basket”, modifies if necessary (quantities, references …), checks delivery address or informs a new one. Then shipping costs are calculated and submitted to buyer, along with name of carrier. Then, buyer chooses his desired payment method: “Payment by transfer”. Finally, last step offers to check all information, read and accept these terms and conditions by checking corresponding box; then invites to validate order by clicking on button “Confirm my order”. This last click forms final conclusion of contract. Upon validation, buyer receives a purchase order confirming registration of his order.
In order to finalize payment and trigger order processing, buyer must contact his bank to make transfer corresponding to order amount to MASTER TOILES company bank account, whose details are provided to buyer. Upon receipt of transfer, order will be processed and buyer will be informed by e-mail. MASTER TOILES COMPANY will dispatch products at earliest 2 working days after receipt of transfer corresponding to the order, subject to provisions.
– Secure payment by PAYBOX or credit card (via the VERIFONE – PAYBOX system): Buyer selects products he wants to order in the “basket”, modifies if necessary (quantities, references …), checks delivery address or informs a new one. Then shipping costs are calculated and submitted to buyer, along with name of carrier. Then, buyer chooses his desired payment method: “Payment by PAYBOX”. Next step is to check all information, read and accept these terms and conditions by checking corresponding box, then invites to validate order by clicking on button “Confirm my order”. Finally, Buyer is redirected to secure PAYPAL interface in order to securely inform his PAYBOX account credentials or personal credit card. If payment is accepted, order is registered and contract definitively formed. Payment by PAYBOX account or by credit card is irrevocable. In case of fraudulent use of this one, the purchaser will be able to demand the cancellation of payment by card; sums paid will be then credited or returned. Responsibility of the holder of a credit card isn’t engaged if disputed payment has been proven fraudulently done, remotely, without physical use of his card. In order to obtain reimbursement of fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must challenge, in writing, the withdrawal from his bank, within 70 days of the transaction, or 120 days if the contract linking them so provides. Amounts withdrawn are reimbursed by the bank within a maximum of one month after receipt of written dispute formed by the holder. No expenses of restitution of sums can be charged to holder.
Confirmation of an order implies acceptance of these sale conditions, acknowledgment of having perfect knowledge and waiver of its own purchase terms. All data provided and recorded confirmation will be the worth proof of transaction. If Buyer has an e-mail address and if he has entered it on his order form, MASTER TOILES company will communicate to him by e-mail confirmation of his order registration.

Article 5. Retention of title
MASTER TOILES company retains full ownership of products sold until perfect collection of price, in principal, expenses and taxes included.
Article 6. Retraction
Under Article L121-20 of Consumer Code, Buyer has a period of fourteen working days from order delivery to exercise his right of withdrawal and thus return product to seller for exchange or refund without penalty, except for cost of return.
Article 7. Delivery
Deliveries are made to address indicated on order form, which can only be in the agreed geographical area. Orders are delivered by GEODIS or DPD delivery services, with tracking. Delivery times are only indicative; if they exceed thirty days from the order, sale contract may be terminated and Buyer refunded. MASTER TOILES company will be able to provide by email to Buyer the tracking number of his parcel. In case of Buyer absence, he will receive a passage notice. Transport risks are responsibility of purchaser, from the moment articles leave premises of MASTER TOILES company. Buyer is obliged to check in presence of deliveryman, condition of the packaging of goods and its contents. In case of damage during transport, any protest must be made to carrier within three days of delivery.
Article 8. Warranty
All products supplied by MASTER TOILES benefit from legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned to MASTER TOILES who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to following address: MASTER TOILES – ZI DE PLAISANCE – 16300 BARBEZIEUX – France, either by email at following address: master-toiles@wanadoo.fr within thirty days after delivery.
Article 9. Liability
MASTER TOILES company, in process of distance selling, is held only by an obligation of means. It can’t be held responsible for damage resulting from use of Internet network such as loss of data, intrusion, virus, break of service, or other involuntary problems.
Article 10. Intellectual Property
All elements of website www.mastertoiles.com are and remain exclusive intellectual property of MASTER TOILES. Nobody is allowed to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in form of photo, logo, visual or text.
Article 11. Personal data
MASTER TOILES company undertakes to preserve confidentiality of information provided by Buyer, which he would have to transmit for use of certain services. All information concerning him is subject to provisions of Law No. 78-17 of 6 January 1978. As such, User has a right to access, modify and delete information about him. Article 12. Dispute Resolution
These conditions of distance selling are subject to French law. For any litigation, competent court will be the Commercial Court of Angoulême (16000 France).
