GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

Article 1 – Purpose and Identification

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between: The Company: MASTER TOILES, a SAS (Simplified Joint Stock Company) with a capital of €28,567.11. Registered Office: ZI de Plaisance, 16300 Barbezieux-Saint-Hilaire, France. Registration: RCS Angoulême No. 351 312 970. Contact: contact@mastertoiles.com | Phone: +33 (0)5 45 98 94 98. Website: https://mastertoiles.com/ and, on the other hand, any natural or legal person wishing to make a purchase via the MASTER TOILES website.

Important Note: MASTER TOILES is the exclusive manufacturer of all products (stretched canvases, bare stretchers, linen and jute canvas rolls) offered on its site. This quality ensures the buyer has direct control over production and the quality of materials (wooden frames, canvases, coatings). Any order placed on the site implies the buyer's full and unreserved acceptance of these GTCS.

Article 2 – Products and Custom Quotes

2.1 Catalog Products The products offered are those appearing on the site, subject to availability. MASTER TOILES takes the greatest care in presenting its products. However, minor variations may exist, particularly in the color rendering of canvases depending on screen settings, which does not engage the company's liability. As a manufacturer, MASTER TOILES reserves the right to make technical improvements to its products as long as this does not alter their quality.

2.2 Custom Quote Requests For any request regarding dimensions or finishes not included in the catalog, the buyer is invited to use the quote form. Data Protection: To establish your quote, we collect personal information (name, address, phone, email). This data is strictly reserved for the technical study of your project, commercial follow-up, and the conversion of your quote into an order. It is not used for any other purpose nor shared with third parties.

Article 3 – Pricing

Prices are indicated in Euros (€) including all taxes (TTC), taking into account the VAT applicable on the day of the order. MASTER TOILES reserves the right to modify its prices at any time. Shipping costs are calculated before final validation. Free Shipping: Delivery is free in mainland France for purchases of €289 (incl. VAT) or more.

Article 4 – Ordering and Payment

The buyer must create an account to finalize their order. The contract is definitively formed upon clicking "Order Confirmation." Payment Methods:

  • Credit Card (PAYBOX / Verifone): Secure and irrevocable payment.

  • Bank Transfer: Order reserved for 7 days. Processing begins upon actual receipt of funds.

  • Installment Payment (PAYPLUG / Oney): Payment in 3X or 4X installments without fees for orders over €200.

4.1 3x 4x Oney Payment (Interest-Free)

  • Eligibility: This financing solution is reserved for individuals (adult natural persons) residing in France. It is available for orders between €200 and €1,000. Only Visa or MasterCard credit cards with a validity longer than the financing term are accepted. Systematic authorization cards (Electron, Maestro), e-cards, and American Express are excluded.

  • Terms and Fees: By choosing this option, the client benefits from interest-free credit (fixed APR of 0%).

  • Withdrawal: The client has a legal withdrawal period of 14 days to cancel their credit.

Article 5 – Delivery and Transfer of Risk

5.1 Delivery Times Delivery times are indicative. For information, orders usually leave the Master Toiles workshops on average 5 business days after validation. In the absence of a specific agreement, delivery occurs no later than 30 days after the order.

5.2 Transfer of Risk and Claims Risk is transferred to the client at the moment they take physical possession of the package (Art. L216-4 of the French Consumer Code). Important: The buyer must check the condition of the packaging in front of the delivery driver. In case of damage, you must write the following on the transport slip: "Goods damaged" (and not "Package damaged").

Article 6 – Right of Withdrawal

6.1 Standard Products In accordance with Article L221-18 of the Consumer Code, the buyer has 14 calendar days to exercise their right of withdrawal. Products must be returned in their original packaging, in perfect condition. Return costs are the exclusive responsibility of the buyer.

6.2 Exclusion for Custom-Made Products In accordance with Article L221-28 3°, the right of withdrawal does not apply to goods made to the buyer's specifications or clearly personalized (custom-sized stretchers and canvases).

Article 7 – Warranties and Manufacturer Liability

All products benefit from the legal warranty of conformity (2 years) and the warranty against hidden defects (Art. 1641 of the Civil Code). As a manufacturer, MASTER TOILES also assumes liability for defective products (Art. 1245 et seq. of the Civil Code) in the event of a product safety defect.

Article 8 – Personal Data (GDPR)

Data collected is necessary for order management and quotes. In accordance with the GDPR, the buyer has the right to access, rectify, and delete their data via contact@mastertoiles.com.

Article 9 – Consumer Mediation

In the event of an unresolved dispute, the buyer may use a consumer mediator free of charge. ODR Platform: https://consumer-redress.ec.europa.eu/

Article 10 – Applicable Law and Jurisdiction

These GTCS are subject to French law. In the event of a dispute with a professional, exclusive jurisdiction is assigned to the Commercial Court of Angoulême.
